GENIUS and CLARITY: Where the Two Frameworks Interlock

Two Statutes, One Argument

GENIUS and CLARITY read like two separate bills solving two separate problems. Treated together, a single argument runs underneath both: Congress is building a perimeter around US dollar-denominated digital value, one statute at a time, and the seam between the two bills is not incidental.

The Shared Seam: Stablecoin Yield

GENIUS bans a payment stablecoin issuer from paying interest or yield on holdings. The ban applies to issuers, not to every entity that touches a stablecoin. Exchange reward programs have built activity the American Bankers Association argues functions as interest by another name. CLARITY is where that argument is being fought out in real time.

Sequencing Logic

Payment stablecoins were the more tractable problem, a single asset type with a clear reserve model, which is why GENIUS could pass first around a narrower scope. Digital commodities, DeFi, and ancillary assets are a wider and messier category, which is why CLARITY has taken longer.

The Administrative Bridge

The SEC and CFTC's March 17, 2026 joint interpretive release (Release Nos. 33-11412 and 34-105020) already did administratively what CLARITY is meant to do by statute for a defined set of sixteen assets: name them digital commodities and settle the classification question. That release is real relief, but it is reversible by a future Commission in a way a signed statute is not. Treat the interpretation as a preview of CLARITY's intended effect, not a substitute for it, and do not let the March relief lower the urgency of tracking the bill itself to passage.
